What exactly does compulsory VMP liability insurance cover?

Compulsory insurance is a third-party liability policy. This means it covers damage that you, as the scooter rider, may cause to other people or their property while riding. The minimum legal cover established by Law 5/2025 is:

  • Personal injury: up to 6,450,000 € per incident, regardless of the number of victims. Covers medical expenses, hospitalisation, rehabilitation, disability and death.
  • Property damage: up to 1,300,000 € per incident. Covers damage to vehicles, property, infrastructure and any third-party assets.

Liability insurance does not cover own damage to the scooter, theft, roadside assistance or the rider's own injuries. Optional add-on covers are available from insurers for those contingencies.

What compulsory insurance does NOT cover

It is important to know the limits of compulsory cover to avoid surprises after an incident:

  • Scooter theft: liability insurance does not cover theft. You need a policy with theft cover for that.
  • Own damage: if you fall and the scooter breaks, compulsory insurance does not pay for repairs.
  • Your own injuries: if you have an accident with no other party involved, liability insurance does not cover your medical expenses. You would need personal accident insurance.
  • Riding in prohibited areas: if the accident happens while you were riding in a prohibited area (pavement, motorway), the insurer may refuse to cover the incident or reclaim the compensation paid.
  • Riding under the influence of alcohol or drugs: the policy is void if the rider was under the influence of substances at the time of the incident.

How to take out electric scooter insurance

The process for taking out liability insurance is as follows:

  1. First register your scooter with the DGT and obtain the certificate with the registration number. Without this number, no insurer can issue a policy. This is the most important step and the one most people miss.
  2. Compare insurers. Use an online insurance comparison site or consult directly with your usual insurer. Many general insurers (AXA, Mapfre, Allianz, Mutua Madrileña, Fiatc) already have specific VMP products.
  3. Provide the vehicle details: registration number, brand, model, serial number and technical specifications (weight, power).
  4. Choose your cover. Minimum legal cover is usually the cheapest. Consider adding theft or roadside assistance if you use the scooter daily.
  5. Pay the premium and save the insurance certificate on your phone. This is the document you will need to show to officers alongside the registration certificate.

How much does scooter insurance cost? Factors that influence the price

The price of insurance varies depending on several factors:

  • Scooter weight: those under 25 kg have lower premiums (35–80 €/year). Those over 25 kg are priced higher (80–200 €/year) as they are considered higher risk.
  • Geographic area: in large cities with heavy traffic, some insurers apply slightly higher premiums.
  • Age and profile of the rider: some products take into account the claims history or the policyholder's age.
  • Optional covers: each optional cover (theft, legal protection, roadside assistance) increases the premium.
  • Insurer: prices between companies can vary by up to 50% for the same cover. It is worth comparing.

What happens if I have an accident without insurance?

If you cause an accident without compulsory insurance, you assume full, unlimited personal liability for the damage caused. This can include:

  • Full medical expenses of the injured parties, which can run to tens or hundreds of thousands of euros.
  • Compensation for permanent disability or death, which can exceed one million euros under current scales.
  • Property damage to vehicles or other assets.
  • Legal fees and court costs if the injured party sues you.

In cases of serious damage, the debt can be enforced against your present and future assets. The Consorcio de Compensación de Seguros may pay the victims and then claim the full amount back from you.

Scooter insurance for shared or family use

If several family members use the same scooter, the policy must cover the vehicle owner and, depending on the insurer, may also extend to authorised riders. Check with your company whether the policy covers any rider or only the policyholder.

If the scooter is used by a minor, the policy is still compulsory and must be taken out by the legal guardian. Civil liability of minors falls on parents or guardians.

Differences between compulsory and voluntary insurance

Two types of scooter insurance exist in the market:

  • Compulsory liability insurance: the legal minimum required by Law 5/2025. Only covers damage to third parties. The cheapest option.
  • Voluntary VMP insurance: includes additional covers such as theft, own damage, roadside assistance, legal protection and rider accidents. More comprehensive and more expensive, but recommended if the scooter is your main means of transport.

For occasional use or a low-value scooter, basic compulsory insurance may be sufficient. For mid-to-high-range scooters used daily, it is worth considering more comprehensive cover.

Frequently asked questions about scooter insurance

Can I take out insurance before registering the scooter?

No. Insurance requires the registration number assigned by the DGT to be issued. Without that number, the policy cannot be linked to the vehicle. The order is mandatory: registration first, then insurance.

Does my home insurance already cover my scooter?

Some home policies include liability cover for non-motorised vehicles or personal electrical appliances, but they generally do not specifically cover VMP vehicles. Check the specific terms of your policy before assuming you are covered. In any case, Law 5/2025 requires a specific policy for the VMP.

What happens if the insurance lapses?

If you let the insurance lapse without renewing it, you immediately incur the offence of “not having insurance in place” (202–610 €) and, if you ride, “riding without insurance” (250–800 €). Set renewal reminders with sufficient notice.

Can the insurer cancel my policy?

Yes. Insurers can cancel a policy if they detect false information in the contract, if the scooter does not meet the declared technical requirements, or for non-payment of the premium. In that case, you are without cover from the date of cancellation.
